• Mit der Wiedervereinigung Deutschlands setzte auch ein Transformationsprozeß in den neuen Bundesländern ein, der die wirtschaftliche Staatstätigkeit als Folge des Sozialismus in die soziale Marktwirtschaft überführen sollte. Dabei wird von staatlicher Seite auch heute noch davon gesprochen, Aufgaben, die durch den Staat erledigt werden, an Dritte auszulagern. Anspruch und Wirklichkeit der Auslagerung von Aufgaben und Leistungen in Landesbetriebe werden in dieser Arbeit untersucht. Ausgangspunkt für dieses Anliegen ist der ursprüngliche Wille des Gesetzgebers, Aufgaben an Dritte abzugeben. Inkonsequent ist dann der Schritt, definierte Aufgaben lediglich in die Organisationsform des Landesbetriebes zu überführen. Zur näheren Untersuchung werden Vergleiche mit der Aufgabenwahrnehmung in den Bundesländern Hamburg, Bayern und Rheinland-Pfalz heran gezogen. Gibt es dafür Abwägungsverfahren? - Gibt es sinnvolle Alternativen zur vorherrschenden Privatisierungsform im Land Brandenburg?…
• With the reunification of Germany a transformation process took place in the new federal states that was supposed to transfer the economical activities of the state resulting from socialism to the social market economy. Until now, the outsourcing of tasks performed by the state to a third party is still discussed at state level. Claims and realities of the outsourcing of tasks and performances to state enterprises are under study. The triggering point of this matter is the initial will of the legislator to hand over tasks to a third party. However, the step of merely transferring defined tasks within the organisational forms of the state enterprises is then an inconsistent one. For a closer investigation, comparisons are drawn between the exertion of tasks in the federal states of Hamburg, Bavaria, and Rhineland-Palatinate.
